（6）     業(yè)主派遣技術(shù)人員或法定檢驗機構人員發(fā)現的貨物質(zhì)量缺陷或不符合本合同規定標準時(shí)，賣(mài)方給予充分考慮并自費采取必要措施，若賣(mài)方確認上述缺陷存在，則賣(mài)方必須排除缺陷，以保證貨物質(zhì)量，并按原定計劃交貨。當貨物質(zhì)量缺陷排除后，賣(mài)方應再次進(jìn)行試驗，以供檢驗，由此引起的費用由賣(mài)方承擔。如果賣(mài)方對業(yè)主派遣技術(shù)人員或法定檢驗機構人員整改意見(jiàn)拒不接受并且不采取措施改正錯誤時(shí)，業(yè)主有權停止支付合同價(jià)款并且向賣(mài)方追償因此遭受的損失
The Seller shall give full consideration to the quality defects of the goods or non-compliance with the provisions of this Contract detected by the technical personnel designated by the Owner or the personnel of the statutory inspection authority and shall, at its own expense, take necessary measures. If the existence of the above defects is confirmed, the Seller must eliminate the defects to meet the required quality level and deliver the goods as scheduled. When the quality defects of the goods are removed, the Seller should make retest for the further examination with the costs borne by itself. If the Seller rejects to accept the comments for correcting the defects of the goods proposed by the Owner’s technical personnel or the personnel of the statutory inspection authority and fails to take corrective measures, the Owner is entitled to stop payment of the contract price and claim the losses suffered by it against the Seller.

1)    向業(yè)主提交本設備的包括但不限于平面布置圖、基礎位置、輔助建筑物的位置及幾何尺寸、功能用房要求、基礎荷載、機電條件、預留孔洞及溝槽圖、預埋件圖、預埋管線(xiàn)圖、安裝條件、入場(chǎng)條件等及為完成本臺設備建造的其他專(zhuān)業(yè)所需的各種配合條件
The data and information about this equipment that shall be submitted to the Owner include but are not limited to the layout plane, foundation positions, positions and sizes of the auxiliary buildings, requirements for the functional rooms, load of the foundation, electrical and mechanical conditions, details of the pre-formed holes and channels, details of the embedded parts, details of the embedded pipelines, installation conditions, access conditions and all supporting conditions required by other trades for establishment of this equipment.

Labor costs for disassembly of the Ride to correct the defect, removal of the defective component or part, installation of the corrected component or new part and re-assembly of the Ride shall be by the Buyer at his expense, as long as the replacement can be done by the Buyer with reasonable efforts and at reasonable cost. The duty and other tax for import of replacement component shall be at the Seller's expense. Return of faulty components or parts or delivery of the replacements or any parts thereof to the Seller shall be at the Seller's expense. Return of repaired components or parts to the Buyer shall be at the Seller's expense. Replacements of the faulty parts that are emergently needed shall be delivered to the site by air express at the Seller's expense.

Our Party undertakes that Our Party is fully responsible for the safety of design and of products supplied by our party under this Contract (including goods, services and all relevant production activities etc), their manufacturing, installation guide services, debugging (including inspection and acceptance check) and operation (the Owner enables correct use and maintenance in accordance with the Seller's operation and maintenance manual) in the whole process of design service life cycle of the aforesaid products, with the preconditionthat the Owner follows strictly all the requirements (included but not limited to drawings, manuals, instructions, etc.) from our Party and keeps detailed records of product operation and maintenance as well as proving that all the aforesaid requirements have been strictly followed.
